RESOLVED that Councillor R Brown be appointed as Chair for this meeting.

3.

Exclusion of Press and Public

To consider whether to exclude the press and public for the item of private business below on the grounds of the likely disclosure of exempt information as defined in the Local Government Act 1972, in particular paragraph 1 of Part 1 of Schedule 12A of that Act.

Minutes:

RESOLVED that, under Section 100(A) of the Local Government Act 1972, the press and the public be excluded from the meeting for the item of business referred to in Minute 5 below headed “Appeals – Community Services – Care Service Contributions”, on the grounds that this item involves the likely disclosure of exempt information as defined in Schedule 12A of that Act, in particular Paragraphs 1 and 3 of Part 1 of that Schedule.

4.

Any other items of public business which the Chair decides to take as matters of urgency because of the special circumstances involved

5.

Appeals - Community Services - Care Service Contributions

To hear a number of appeals against Care Service Contributions. 

Minutes:

The Committee considered an appeal by Mr KW against an assessment of charges for his care package contribution.

 

The Operational Manager, Financial Assessments, explained to the Committee how the assessed contribution had been calculated and why some elements of income were disregarded.

 

The Head of Social Work - Mental Health and Sustainability provided the Panel with information regarding KW’s physical disabilities and his mental health.  She also explained that the private therapy he is currently receiving was not an assessed need that should be met by social care and meeting health needs is the responsibility of health services. 

 

The Committee received written and oral representations from KW in respect of the grounds for appeal against the assessed care contribution.

 

RESOLVED that, having considered the representations made and given careful consideration to the totality of the financial circumstances of the appellant, the Committee recommended that:

 

1.  The Head of Social Work - Mental Health and Sustainability shall ensure that the social worker liaises with the CCG within 2 weeks of receipt of this letter.  The purpose is for the CCG to give consideration to funding the private therapy KW is currently accessing.  KW provided his consent for such discussions to take place.

 

2.  The Operational Manager, Financial Assessments shall consider whether a review of KW’s disability related expenditure needs to be undertaken depending upon the outcome of the decisions of the CCG.  If such a review does take place that will give you a right of appeal in the future.

 

6.

Any other items of private business which the Chair decides to take as matters of urgency because of the special circumstances involved.
