The Committee considered a report of the Strategic Lead, Planning and Major Developments detailing the above application for the demolition of existing buildings and erection of 5 detached residential dwellings and associated ancillary works. The application was recommended for approval subject to conditions.

 

The late representations document tabled at the meeting outlined further conditions in relation to drainage. In addition, a late representation that was received was reported at the meeting.

 

A registered speaker was present at the meeting and spoke in respect of his objections to the application. A statement objecting to the application was read out on behalf of registered speakers. The applicant’s representative was also present at the meeting and spoke in support of the application.

 

Following consideration of the report and the representations made at the meeting, the Committee considered that given the scale of the proposal, a condition be added to prevent any further development and external storage on the site within the area hatched green on the final approved drawings.

 

RESOLVED that planning permission be granted in respect of Application FUL/2020/0966 subject to conditions listed within the report, the conditions listed within the late representations document and the additional condition mentioned above restricting any further development.

 

(Note: Councillor S Walsh did not vote as he was not present for the entire discussion on the application.)

Enforcement Issue

Minutes:

The Committee considered whether or not the City Council as local planning authority should instigate the appropriate enforcement action in respect of the breach of planning control as notified to them in respect of the wilful destruction of a tree which was the subject of a Tree Preservation Order. 

 

This was in accordance with the Constitution which required that all planning enforcement prosecutions be authorised by Planning Committee.

 

RESOLVED that Planning Committee delegates (a) the formal prosecution of the case and (b) the seeking of suitable compensation for the loss of the tree; as reported in respect of the wilful destruction of a protected tree at Paxton Lodge, London Road, to the Strategic Lead, Planning and Major Developments and the Director of Finance and Corporate Services.

 

(Note: This item was taken as an urgent item of private business due to the nature of the breach and to expedite any appropriate enforcement action needed.)
