The Committee considered a report of the Head of Planning and Regulation detailing the above application for retention of the single storey building to be used as a hot food takeaway (use class A5) and associated external flue, which was recommended for approval.

 

A registered speaker attended the meeting and spoke in respect of his objections to the application. The applicant’s representative also attended the meeting and spoke in support of the application.

 

It was reported at the meeting that a modified roof design had been received from the applicant. The revised design was more in keeping with the neighbouring roof. 

 

RESOLVED that planning permission be granted in respect of application FUL/2019/1087 subject to conditions.

The Committee considered a report of the Head of Planning and Regulation detailing the above application for the erection of four dwellings together with associated parking and landscaping, which was recommended for approval.

 

The Late Representation report indicated the contribution sought by the NHS was £4,871. A verbal late representation indicated the contribution sought by Parks and Green Spaces was £1500.

 

Councillor G Williams, a Bablake Ward Councillor attended the meeting and spoke in respect of his objections to the application. The applicant’s representative also attended the meeting and spoke in support of the application.

 

Following consideration of the application and matters raised at the meeting, the Committee considered that the siting of the proposed 4 houses within the area of landscaping and public open space designated in the original development and the resulting loss of part of this space would be unacceptable.

 

RESOLVED that planning permission be refused in respect of application FUL/2019/1269.

The Committee considered a report of the Deputy Chief Executive, Place, which outlined the investigations to extinguish part of footpath M317 in the City of Coventry.  An application had been submitted by the residents of 22 Bantam Grove, Coventry, CV6 2GN who owned the land crossed by a section of the path.

 

RESOLVED that Planning Committee:

 

(1)  Authorise the City Solicitor to make the necessary Extinguishment Order for Public Footpath M317, (part), at Bantam Grove, City of Coventry pursuant to Section 118 of the Highways Act 1980 on the grounds that the City Council is satisfied that it is expedient to do so as the path is not needed for public use. 

 

(2)  Authorise the public Notice of the making of the Order and in the event of there being no objections within the period specified, the Order be confirmed in the exercise of the powers conferred on the Council by the said Act.

 

(3)  Endorse that in the event that objections be received to the making of the Order that cannot be resolved, then the matter be forwarded to the Secretary of State for determination and Coventry City Council be responsible for the conduct of any hearing or public inquiry.

The Committee noted a report of the Head of Planning and Regulation which provided information on appeals lodged and determined in the period 1 May to 30 June 2019.  The report set out the main issues of the appeals and summarised the decisions, together with details of any costs which were made and/or awarded, either for or against the Council.
