The Committee considered a report of the Head of Planning and Regulation detailing the above outline application for the erection of two residential dwellings; seeking permission only for access, all other matters are reserved. The application was recommended for approval.

 

The Committee also considered a petition objecting to the application, bearing 44 signatures, which had been submitted by Councillor Harvard, a Longford Ward Councillor. Councillor Harvard attended the meeting together with the petition spokesperson and both spoke in respect of the petition.  In addition, a registered speaker also spoke in respect of his objections to the application. The applicant’s agent also attended and spoke in support of the application.

 

RESOLVED that planning permission be granted in respect of Application OUT/2017/2879 subject to conditions.

Wildlife and Countryside Act 1981 Section 53, Application to add a Public Footpath from Broad Lane to Fir Tree Avenue pdf icon PDF 138 KB

The Committee considered a report of the Deputy Chief Executive (Place) in respect of an application to have a route recorded on the Definitive Map and Statement as a public footpath. 

 

As a result of investigations into the application, authorisation was sought to make a Definitive Map Modification Order.  The report included a discussion of the consultations carried out in respect of the claim, the historical evidence, witness evidence and the legal tests for a Definitive Map Modification Order to be made. The report’s recommendation was based on that information, for decision by Members as to whether an Order should be made to add the route as a public footpath.

 

RESOLVED that the Committee:

 

(1)   Authorise the Deputy Chief Executive Place to make the necessary Definitive Map Modification Order for the following route from between 171 and 175 Broad Lane to between 151 Fir Tree Avenue and 173a Broad Lane (on Fir Tree Avenue) in the City of Coventry pursuant to Section 53(3)(c)(i) of the Wildlife and Countryside Act 1981 by adding this route as a Public Footpath, as shown between points A-B on plan ref: Ref:T&T/ALM/X0010/Cttm2018 at Appendix 1.

 

(2)    Agree that a public notice of the making of the Order be given and, in the event of there being no objections within the specified time period, or any objections received being withdrawn, the Order be confirmed in exercise of the power conferred on the Council by the said Act.

 

(3)    Agree that, should objections be received to the making of the Order that cannot be resolved, then the matter be forwarded to the Secretary of State for determination.

Changes to Enforcement Process

Minutes:

The Committee considered a joint report asking them to consider whether or not the existing historical convention of reporting all enforcement matters to Planning Committee before instigating formal action should continue. 

 

RESOLVED that officers utilise their existing delegated powers as outlined within the current constitution to serve enforcement notices and other statutory notices where appropriate should negotiations fail.

 

137.

Enforcement Report

Director of Finance and Corporate Services & Head of Planning & Regulation

Minutes:

The Committee considered a joint report which requested the Committee to consider whether or not the City Council as local planning authority should instigate the appropriate enforcement action in respect of the breaches of planning control as identified within Table 1 of the report. 

 

This report was in accordance with the Constitution which required that all planning enforcement actions and prosecutions be authorised by Planning Committee.

 

RESOLVED that Planning Committee:

 

(1)  Delegate authority to the Head of Planning and Regulation and the Director of Finance and Corporate Resources to serve the appropriate  enforcement and other statutory notices in respect of the following properties as identified within Table 1 (Notices and Prosecutions):

a.   70 Gregory Avenue

b.   8 Friars Road

c.   10 Friars Road

d.   102 Brinklow Road

e.   21 Wrigsham Street

f.   Land at Middle Ride

g.   2 Telfer Road

h.   52 Dean Street

(2)  Delegate authority to the Head of Planning and Regulation and the Director of Finance and Corporate Resources, the formal prosecutions of the cases set out in Table 1 (Notices and Prosecutions) should negotiations fail.

 

(3)  Delegate authority to the Head of Planning and Regulation and the Director of Finance and Corporate Resources, the formal prosecution of cases whereby enforcement and other statutory notices as identified within Table 1 (Notices and Prosecutions) have not been complied with, and the undertaking of works in default to secure compliance where appropriate.

 

(4)  Note the content of Table 2 (Update of Outstanding Actions).
