The minutes of the Committee meeting held on 3 March 2020 were agreed and signed subject to the addition of Councillor G Ridley to the list of apologies.

Counterfeit Understrength Vodka

Minutes:

RESOLVED that, having considered a report of the Director of Street Scene and Regulatory Services:

 

1.  The Council Solicitor be authorised to institute legal proceedings under the Trade Marks Act 1994, the Food safety Act 1990 and the Consumer Protection from Unfair Trading Regulations 2008 against appropriate persons in respect of the alleged counterfeit understrength vodka found at Mike Roberts Foodstores Limited, 76 Jardine Crescent, Coventry.

 

2.  That authority be delegated to the Director of Street Scene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

 

The Committee noted that the premises would be recommended to seek a minor variation on the Premises Licence to add a condition in respect of the purchase of all alcoholic and tobacco products which would require them to provide proof of purchase.

RESOLVED that, having considered a report of the Director of Street Scene and Regulatory Services:

 

1.  The Council Solicitor be authorised to institute legal proceedings under the Trade Marks Act 1994, the Food safety Act 1990 and the Consumer Protection from Unfair Trading Regulations 2008 against appropriate persons in respect of the alleged counterfeit vodka found at SKM Convenience Store, 483 Holyhead Road, Coventry.  

 

2.  That authority be delegated to the Director of Street Scene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

Underage Sale and Possession of illegal Tobacco Products

RESOLVED that, having considered a report of the Director of Street Scene and Regulatory Services:

 

1.  The Council Solicitor be authorised to institute legal proceedings under the Children and Families Act 2014, the Trade Marks Act 1994, the Consumer Protection from Unfair Trading Regulations 2008, the Standardised Packaging of Tobacco Products Regulations 2015 and the Tobacco and Related Products Regulations 2016  against appropriate persons in respect of the alleged underage sale and possession of illegal tobacco products found at General Grocers, 305-307 Foleshill Road, Coventry. 

 

2.  That authority be delegated to the Director of Street Scene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

RESOLVED that, having considered the circumstances set out in the report of the Director of Street Scene and Regulatory Services now submitted:

 

1.  The Hackney Carriage Driver’s Licence held by Mr Baraj Singh Athwal be revoked.

 

(Note: Mr B S Athwal chose not to participate in the remotely held  meeting and chose not to submit any further written representation in support of his case.)
