The Committee considered a report of the Deputy Chief Executive (Place) which sought approval to waive the requirement to hold a Sex Establishment Licence, for a two-day Erotica Trade Only (ETO) Show, to be held at the Ricoh Arena in March 2020. The event overview was appended to the report.

 

Schedule 3 of the Local Government (Miscellaneous Provisions) Act 1982 makes provision for the Council to grant a waiver from the requirement to hold a Sex Establishment Licence in any case where it considers that to require a licence would be unreasonable or inappropriate. A waiver may be for such a period as the Council thinks fit. A copy of the relevant section of the legislation was attached as Appendix 2 of the report.

 

The event would be a trade only event and admission to the event was strictly by invitation only. There would be no access to general public and there was no wider advertising of the event to the general public. The event is strictly over 18’s and controls would be in place to verify this at the event.

 

There would be no commercial transactions or sales made at the event, it would be a ‘networking’ event whereby suppliers would be able to showcase and display their products to operators of licensed premises, who would then buy directly from the exhibitors after the event.

 

The event organiser had confirmed that there would be no R18 DVD’s on display at the event as that would require a Sex Establishment Licence.

 

 

RESOLVED that the Committee agrees to waive the requirement to hold a Sex Establishment Licence for a two day Erotica Trade Only show to be held at the Ricoh Arena in March 2020.

RESOLVED that, having considered the circumstances set out in the reports of the Deputy Chief Executive (Place), now submitted:

 

(a)  The Hackney Carriage Driver’s Licence held by Mr Nim Singh Bangay be suspended for a period of three months.  The Committee also recommended that Mr Bangay attend a training course in relation to customer services.

 

  (Note: Mr N S Bangay and his Unite the Union representative attended the  

  meeting in support of his case)
