Minutes:

Councillor Thomas declared an ‘Other Interest’ in the matter referred to in Minute 64(a) below relating to “Review of Hackney Carriage Driver’s Licence”. The interest arose as she is Chair of the Cabinet Member for Policing and Equalities – Disability Equality Advisory Panel. She remained in the meeting for the consideration of the item.

Counterfeit Mobile Phones & Headphones

Minutes:

RESOLVED that, having considered a report of the Deputy Chief Executive (Place):-

 

1)  The Council Solicitor be authorised to institute legal proceedings under the Trade Marks Act 1994 and the General Product Safety Regulations 2005 against appropriate persons in respect of the discovery of the sale and supply of counterfeit mobile phones and headphones at SPD Online Ltd, t/as Super Phonedeals, 268 Harnall Lane East, Coventry.

 

2)  That authority be delegated to the Director of Streetscene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

Non-compliance with a Formal Notice under the Prevention of Damage by Pests Act 1949 (WK/217032987)

Minutes:

RESOLVED that, having considered a report of the Deputy Chief Executive (Place):-

 

1)  The Council Solicitor be authorised to institute legal proceedings under the Prevention of Damage by Pests Act against appropriate persons in respect of the alleged non-compliance with a Formal Notice served under the above Act on the owners of 2 Cherry Close,  Coventry.

 

2)  That authority be delegated to the Director of Streetscene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

General store found with food beyond "Use by" date "Unsafe" toys and illegal cigarettes in possession for sale

Minutes:

RESOLVED that, having considered a report of the Deputy Chief Executive (Place):-

 

1)  The Council Solicitor be authorised to institute legal proceedings under the Food Safety and Hygiene (England) Regulations 2013, the Toy Safety Regulations 2011, General Product Safety Regulations 2005 and Tobacco and Related Products Regulations 2016 against appropriate persons in respect of the alleged food beyond use-by date, unsafe toys and illegal cigarettes in possession for sale found at Stoney Mini Market, 211 Stoney Stanton Road, Coventry.

 

2)  That authority be delegated to the Director of Streetscene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

RESOLVED that, having considered the circumstances set out in the reports of eth Deputy Chief Executive (Place) now submitted:

 

(a)  The Hackney Carriage driver’s licence held by Mr Homayon Rasoly be revoked with immediate effect.

 

(Notes: (i) Mr H Rasoly and his representative attended the meeting in support of his case.

(ii) The complainant and his representative attended the meeting in support of his complaint.)
