Report of the Executive Director of Place

Minutes:

The Committee considered a report of the Executive Director of Place which provided an update on any prosecutions authorised by Committee that had concluded at Court between 1 November 2016 and 27 February 2017.

 

At the Committee meeting held on 24th January 2017, Members indicated that they would like to receive feedback of the results of any prosecutions that were authorised by the Committee once they had concluded at Court. It was subsequently decided that the most appropriate way of achieving this would be a Public Report to the Licensing and Regulatory Committee on a quarterly basis.

 

RESOLVED that the report be noted.

Roofing work carried out for vulnerable customer

Minutes:

RESOLVED that, having considered a report of the Executive Director of Place, the Council Solicitor be authorised to institute legal proceedings under the Consumer Protection from Unfair Trading Regulations (CPUTR) 2008 and the Fraud Act 2006 against appropriate persons in respect of the alleged roofing and home improvement work carried out for a vulnerable customer by (i) Galaxy Home Improvements Ltd, (ii) Ahmed Jamal Barber, (iii) Nadeem Yasin and (iv) Ahmadzai Mohammad Naeem Trading as N and U Building Solutions. 

 

In addition, it was agreed to delegate powers to the Assistant Director of Streetscene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

 

 

72.

Non-compliance with Improvement Notice - Section 12 of the Housing Act 2004

Minutes:

RESOLVED that, having considered a report of the Executive Director of Place, the Council Solicitor be authorised to institute legal proceedings under the Housing Act 2004 against appropriate persons in respect of the alleged non-compliance with an Improvement Notice served under the above Act on the owner of 123-125 Radford Road, Coventry.

 

In addition, it was agreed to delegate powers to the Assistant Director of Streetscene and Regulatory Services to authorise legal proceedings for any further offences which may come to light before the case under consideration has been resolved in court.

RESOLVED that having considered the circumstances set out in the reports of the Executive Director of Place now submitted:

 

(a)  The consideration of the application for the Grant of a Hackney Carriage Driver’s Licence by Mr Mohammed Hanif be adjourned to a future meeting pending further clarification on a number of matters.

 

(Note: Mr M Hanif and his legal representative attended the meeting in support of his application).
